role=\"presentation\">dernier<\/span> <span dir=\"ltr\" role=\"presentation\">\u00e0 l\u2019initiative de France comp\u00e9tences<\/span> <span dir=\"ltr\" role=\"presentation\">invite \u00e0 une r\u00e9flexion<\/span> <span dir=\"ltr\" role=\"presentation\">sur l\u2019univers<\/span> <span dir=\"ltr\" role=\"presentation\">juridique auquel<\/span> <span dir=\"ltr\" role=\"presentation\">Alors que le droit \u00e0 l\u2019\u00e9volution professionnelle, consubstantiel \u00e0 la carri\u00e8re des<\/span> <span dir=\"ltr\" role=\"presentation\">fonctionnaires est garanti par des dispositions<\/span> <span dir=\"ltr\" role=\"presentation\">statutaires<\/span><span dir=\"ltr\" role=\"presentation\">,<\/span> <span dir=\"ltr\" role=\"presentation\">il<\/span> <span dir=\"ltr\" role=\"presentation\">n\u2019en va pas de m\u00eame<\/span> <span dir=\"ltr\" role=\"presentation\">pour les salari\u00e9s du secteur priv\u00e9 pour lesquels les perspectives d\u2019\u00e9volution<\/span> <span dir=\"ltr\" role=\"presentation\">professionnelle sont fonction<\/span> <span dir=\"ltr\" role=\"presentation\">du march\u00e9 du travail<\/span><span dir=\"ltr\" role=\"presentation\">, de la taille de l\u2019entreprise<\/span> <span dir=\"ltr\" role=\"presentation\">et<\/span> <span dir=\"ltr\" role=\"presentation\">de la qualification reconnue par le contrat de<\/span> <span dir=\"ltr\" role=\"presentation\">travail,<\/span> <span dir=\"ltr\" role=\"presentation\">et le<\/span> <span dir=\"ltr\" role=\"presentation\">cas \u00e9ch\u00e9ant<\/span> <span dir=\"ltr\" role=\"presentation\">par la<\/span> <span dir=\"ltr\" role=\"presentation\">convention collective<\/span> <span dir=\"ltr\" role=\"presentation\">applicable.<\/span><\/span><span son avenir<\/span><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">professionnel<\/span> <span dir=\"ltr\" role=\"presentation\">\u00bb<\/span> <span dir=\"ltr\" role=\"presentation\">inspir\u00e9<\/span><span dir=\"ltr\" role=\"presentation\">e<\/span> <span dir=\"ltr\" role=\"presentation\">par la volont\u00e9<\/span> <span dir=\"ltr\" role=\"presentation\">d\u2019accro\u00eetre l\u2019autonomie<\/span> <span dir=\"ltr\" role=\"presentation\">ainsi que la<\/span><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">responsabilit\u00e9<\/span> <span dir=\"ltr\" role=\"presentation\">des personnes et par l\u00e0<\/span> <span dir=\"ltr\" role=\"presentation\">\u00ab de fluidifier<\/span> <span dir=\"ltr\" role=\"presentation\">\u00bb<\/span> <span dir=\"ltr\" role=\"presentation\">le march\u00e9 du travail, s\u2019est<\/span> <span dir=\"ltr\" Toutefois<\/span> <span dir=\"ltr\" role=\"presentation\">la lecture<\/span> <span dir=\"ltr\" role=\"presentation\">du droit positif issu de<\/span> <span dir=\"ltr\" role=\"presentation\">son<\/span> <span dir=\"ltr\" role=\"presentation\">incorporation<\/span> <span dir=\"ltr\" role=\"presentation\">dans le code du travail ne permet pas de conclure \u00e0 l\u2019existence d\u2019un droit<\/span> <span dir=\"ltr\" role=\"presentation\">uni<\/span><span dir=\"ltr\" role=\"presentation\">versel \u00e0 l\u2019\u00e9volution professionnelle garanti par la loi (I)<\/span><span dir=\"ltr\" role=\"presentation\">. En effet,<\/span> <span dir=\"ltr\" role=\"presentation\">selon la<\/span> <span dir=\"ltr\" role=\"presentation\">jurisprudence de la Cour de cassation confirm\u00e9e par le conseil constitutionnel,<\/span> <span dir=\"ltr\" role=\"presentation\">l<\/span><span dir=\"ltr\" role=\"presentation\">\u2019employeur demeure aujourd\u2019hui comme hier \u00ab seul juge de la capacit\u00e9 du<\/span> <span dir=\"ltr\" role=\"presentation\">salari\u00e9 \u00e0 occuper un em<\/span><span dir=\"ltr\" role=\"presentation\">ploi<\/span><span dir=\"ltr\" role=\"presentation\">1<\/span> <span dir=\"ltr\" role=\"presentation\">\u00bb<\/span> <span dir=\"ltr\" role=\"presentation\">et<\/span> <span dir=\"ltr\" role=\"presentation\">par cons\u00e9quent de sa comp\u00e9tence et de son<\/span> <span dir=\"ltr\" role=\"presentation\">\u00e9volution professionnelle<\/span> <span dir=\"ltr\" role=\"presentation\">(II<\/span><span dir=\"ltr\" role=\"presentation\">).
